Microsoft's biggest gamble yet: risking the name 'Windows'

1 day

Microsoft's come a long way in the last two years. Thursday is the official launch of Windows 8. How PC users respond to the radically redesigned and architected operating system may greatly affect the future of Microsoft. But Microsoft's made a big mistake: they've stretched the Windows brand so thin that it's going to confuse customers?--?and maybe even drive them away.

It's not news to Microsoft how important Windows 8 is to the company,?as well as its sister operating system Windows RT that powers the first Microsoft Surface tablet. This is the last chance Microsoft has to get into the race beside Apple and Google for the future of mobile?--?and perhaps desktop?--?computing. But even though Windows 8 was officially announced only?16 months ago, looking at how the tech community ?responded to it at the time reminds how audacious?--?and in hindsight, how essential?--?Microsoft's Windows 8 strategy has become.

Although there was a casual mention of Windows 8 and its ability to run on the ARM-based processors?--?the same sort that power iPhones and mobile tablet?s--?at the 2011 Consumer Electronics Show, the first official look at Windows 8 came at the D9 conference on June 1st, 2011. All Things D's Ina Fried had an exclusive first look and interview with Windows President Steven Sinofsky, who is quoted right out of the gate saying, ?[Windows 8] is ?no compromise? and that?s really important to us."

But there was a compromise to come: Windows 8 doesn't actually run on ARM processors; instead, that's what Windows RT is for. The new "Windows Store" apps?--?think of them like iPad or Android tablet apps?--?run on both Windows 8 and Windows RT devices. But traditional?--?some might say "real"?--?Windows apps like Photoshop or Minecraft will only run on Windows 8 machines that use an x86 chip. (At least until their developers create dual-Windows versions, something Microsoft obviously hopes will become more common.)

There are also native Windows RT apps that just run on RT, just to make it more confusing.

At the time, it was also presumed that Windows Store apps would be more like simple web widgets. Wrote Fried:

The other type of application, which has to be written in HTML5 and Javascript, looks more like a mobile application, filling the full screen. Internet Explorer 10, which is part of Windows 8, has already been configured to run in this mode, as have several widget-like apps for checking stock prices and weather.

Those widgets ended up being quite a bit more like traditional Windows applications, developed in a variety of languages. ) And Windows Store apps for Windows 8 can run on Windows RT as well...sometimes. (To speak nerdy, developers can choose to compile for ARM, but it's not required.)

What becomes apparent when looking through the coverage of Windows 8 from a year-and-a-half, though, is that at the time Microsoft thought it would be able to make a single version of its operating system that would work for desktops, laptops, and tablets alike. (Funnily enough, at the time, Microsoft was calling "Windows 8" a working title; it wouldn't officially name the product until 2012.)

What's clear is this: Windows 8 started as something easy to understand, a unified operating system that would run on all types of hardware. Along the way, Microsoft realized they'd bitten off more than they could chew, split off Windows RT from Windows 8, and sowed a lot of confusion that's going to get worse before it gets better.

What's disappointing in all of this is that Windows 8?--?the full-blown version?--?has been getting mostly high praise from those who have used its many preview builds. ?Tim Anderson, writing for the Guardian, called a summer build proof that Microsoft could have "turned on a pin and transformed its client and consumer operating system from one that is hopelessly bogged down in legacy and unsuited for modern mobile computing, to one that is beautifully engineered for the next generation of cloud-connected devices."?

(Broadly, anyone using Windows 8 on a touchscreen device loves it, while those using a ?keyboard and mouse tend to be of mixed minds.)

But for the first time since Windows NT (which wasn't a consumer-facing version of Windows), Microsoft has been sloppy with its most precious brand.?And that's just at the highest level; inside the operating system and on the web, Microsoft has a supercilious tendency to slap the "Windows" name on everything from DropBox clones ("Windows Live Mesh") to file browsers ("Windows Explorer," not to be confused with "Internet Explorer," Windows' default web browser).

It's a mess. It's confusing. And it's ultimately going to be a big factor in confusion and dissatisfaction for a lot of customers over the coming months. (Especially when you consider there will be another Microsoft Surface tablet coming soon that does run the full-blown Windows 8.)

Yet a quick look at recent history makes one thing clear: Microsoft is making it up as they go along. And that might not be good enough anymore.

Pest Prevention against Insects [Guest Post] ? UK Home ...

There are literally hundreds of thousands of different species of insects in the world and many of them live in your garden or around your house. These little? critters can carry dirt and disease, and are generally unwanted. If you?re worried about insects getting into your home, then our handy point by point prevention guide could be just the thing you?re looking for.

Insects come in all shapes and sizes. On the whole they have six legs, but we?ve extended the definition in this article to include all manner of creepy crawlies and flying pests. Just one can be a mere nuisance, but if they manage to get a toe-hold in your house, they can spread dirt and disease. Of course, prevention is always better than having to get rid of an infestation, which we can help you with. Just check our easy to use point by point guide.

-) The simplest way to stop crawling insects getting into your house is by applying a strong insecticide around areas where they could gain entry. This should usually be available in the form of a spray, although be careful not to use this around areas where children play for obvious reasons.

-) Air vents also provide a possible route for insects to access your property. You should be able to buy a fine mesh grating that will fit over any air-vents. Of course, there are still very small insects that may be able to penetrate this, but it will stop the bigger bugs.

-) Insects can use the smallest of gaps around your windows, doors and other fittings to gain entry into your property. Take a good look at all the cracks and gaps around your windows and make sure these are all sealed properly to ensure no easy access points for insects.

-) You may have seen special kinds of door barriers in shops, particularly butcher?s shops. These ribbon or chain doors form an excellent barrier against flying insects, allowing you to leave your door open in the summer and enjoy a fresh breeze without having to deal with a big influx of pests.

-) Certain types of insects, such as silverfish, are encouraged by left over food or spilled cereals. You can ensure against these little pests by making sure that the areas all round your cooking equipment and spaces is clean and that all loose foodstuffs are stored in resealable boxes to prevent them attracting bugs.

-) If you have a garage or any kind of semi-external room as part of your property, then insects could be using the gap under your door as an entry point. You should be able to find a brush like strip to fit at the bottom of the door which will provide a simple barrier to stop insects from entering your house under the door.

-) Of course, in spring, summer and early autumn months the nights are often too warm to sleep with shut windows. The slightest light source can prove to be a beacon for all manner of night fliers such as moths and mosquitos. Prevent these pests with a fine mesh screen, which forms a preventative barrier against such invaders.

-) If flying insects prove a persistent problem then it might be an idea to invest in an electrical bug zapper. These units, which can be often see in food outlets have two components. First there?s an ultraviolet light source to attract insects and then there?s an electrically charged component that kills these pests.

Ultimately it is impossible to stop all insect attempts to get into your house, but with a bit of care, you can minimise their chances and repel most of these pests before they even get a chance to get in.

Answers sought as $3B Texas cancer agency meets

(AP) ? Texas put $3 billion on the table to prove it was serious about fighting cancer, but it will take more than money to convince scientists that's still the case.

Hundreds of the nation's top cancer researchers want answers and reassurance this week from the embattled Cancer Prevention and Research Institute of Texas, which is reeling after mass resignations and serious internal accusations that have put the nation's second-biggest pot of cancer research dollars in jeopardy.

The agency's annual conference begins Wednesday, with nearly 900 scientists and agency stakeholders expected to attend. Among the notables unlikely to show up: nearly three dozen renowned scientists, including a Nobel laureate, who severed ties with CPRIT this month over a controversial award.

Bill Gimson, the executive director of CPRIT since it was founded in 2007, is denying accusations that politics influence funding decisions as the agency hosts what is expected to be its largest annual conference yet. For three days, CPRIT officials will try to repair a once-celebrated image that was hailed as an unprecedented state-level effort to fight cancer.

"Obviously we will address issues that have surfaced," Gimson said. "I think, more importantly, we will reconfirm our commitment to a gold-standard peer review and picking the very best projects."

Thirty-three of the agency's scientific peer reviewers have recently resigned, many in protest. Nobel laureate Dr. Phillip Sharp, who headed the agency's scientific review council, wrote in a resignation letter this month that the agency is making funding decisions that carry a "suspicion of favoritism" in how the state hands out taxpayer dollars.

Others were more blunt: Dr. William Kaelin of Harvard Medical School, who also served on the council, accused the agency of "hucksterism."

The backlash stems from a $20 million commercialization grant awarded earlier this year for a so-called incubator project at M.D. Anderson Cancer Center in Houston. It was among the largest grants in the agency's young history and was approved without a scientific review, leading the agency's chief scientific officer to step down.

"If I could do that one grant over again, I would do it differently," said Gimson, adding that the agency has since examined its review process.

Gimson said the agency is still searching for a new chief scientific officer and doesn't believe the criticism coming from within the medical community will hamper efforts to replace those who've resigned.

Agency officials at this week's meeting also are scheduled to discuss ? but take no formal action on ? proposed changes to how the state divvies up grant awards between research, prevention and commercialization efforts to bring new drugs to market. The agency has awarded nearly $700 million in grants since 2009, mostly to fund research.

The keynote speaker Wednesday is Dr. Brian Druker, the celebrated oncologist who developed the groundbreaking cancer drug Gleevec.

The conference runs through Friday.

NHL gave clubs 2-day window to talk to players

NEW YORK (AP) ? While negotiators for the NHL and union kept conversations to a minimum, club officials had a brief window last week to discuss the league's latest proposal with its locked-out players.

So far, those discussions haven't produced any breakthrough, but they have inflamed an already unsettled atmosphere. The union hierarchy wasn't informed about the window then, and isn't happy about it, either.

"Most owners are not allowed to attend bargaining meetings," players' association special counsel Steve Fehr said. "No owners are allowed to speak to the media about the bargaining. It is interesting that they are secretly unleashed to talk to the players about the meetings the players can attend, but the owners cannot."

The NHL said Tuesday that team officials may have temporary contact with players, although there are parameters regarding what can be discussed.

"From our perspective, this is a nonissue and a nonstory," NHL deputy commissioner Bill Daly said Tuesday in an email to The Associated Press. "There is nothing ? legally or otherwise ? that precludes club personnel from communicating with their players."

But, more important, is the fact that NHL officials aren't talking to union leaders, and there are still no plans for negotiations to continue after breaking off last week. The hope of reaching a quick deal and getting a full season under way Nov. 2 is quickly evaporating.

If a new collective bargaining agreement isn't reached by Thursday, NHL Commissioner Gary Bettman says a full season won't be able to be played. As of now, the league has called off all games through Nov. 1. Without a deal this week, those games are in danger of being called off for good.

Last week, the NHL's most recent contract offer ? featuring a 50-50 split of hockey-related revenue ? was presented to the union and then publicly released in full. The union returned to the bargaining table last Thursday with three counterproposals, that would also get to an even split of hockey revenue, but each was quickly rejected by the league.

There is a major divide between the sides over how to deal with existing player contracts. The union wants to ensure that those are all paid in full without affecting future player contracts.

No negotiations have taken place since last week, but the sides held two conference calls over the weekend to address questions the union had regarding the NHL offer.

After the NHL released it on Wednesday, club officials were given until Friday to speak to players and answer questions they might have about the proposal.

In an internal league memo obtained by The Canadian Press, the NHL stated that those discussions must be limited to the contents of the proposal on the table. It also provided examples of questions that shouldn't be asked of players and noted that straying from the rules could "cause serious legal problems."

"You may not ask (a player) what he or others have in mind," the memo stated. "If he volunteers what he has in mind you should not respond positively or negatively or ask any questions but instead refer him to the NHLPA.

"Likewise, you may not suggest hypothetical proposals that the league might make in the future or that the league might entertain from the union."

This was the first time club officials were permitted by the NHL to talk to players since the lockout took effect Sept. 16.

Mediator: Syria agrees to Eid holiday truce

The Syrian Foreign Ministry has yet to announce that a cease-fire between government forces and rebels has been finalized. NBC's Duncan Golestani reports.

By NBC News staff and wire reports

Updated at 9:05 a.m. ET: Syria has agreed to a cease-fire during the short Muslim holiday of Eid al-Adha, which begins Friday, international mediator Lakhdar Brahimi said Wednesday at a Cairo news conference.

Brahimi, appointed by the United Nations and Arab League, said some Syrian opposition groups he had been in contact with had also agreed to a truce in principle.

Brahimi did not elaborate on how such a truce would be monitored. Reporting from Syria is difficult and claims made by either side are almost impossible to verify.

Report: At least 20 dead in Aleppo as rebels battle Syria army

Eid al-Adha -- the feast of the sacrifice -- starts on Oct. 26 in the 2012 Gregorian calendar and lasts up to four days.

?After the visit I made to Damascus, there is agreement from the Syrian government for a cease-fire during the Eid,'' Brahimi told a news conference at the Cairo-based League.

He did not give a precise time period for the cease-fire but said Damascus would announce its agreement on Wednesday or Thursday.?Syria's foreign ministry said it was still studying the truce proposal.

Top 10 foreign policy issues facing a new president

President Bashar Assad is fighting an insurgency that grew out of street protests 19 months ago and has escalated into a civil war in which 30,000 people have been killed.

His overstretched army has lost swathes of territory and relies on air power to keep rebels at bay.

Conditions?
It was also not immediately clear what conditions all parties would have to impose to make the cease-fire a success. Rebel forces do not speak with one voice and already one rebel commander has said he has conditions that must be met.

Nevertheless, Brahimi said there was broad agreement on the truce.?

A look back at the violence that has overtaken the country

?Other factions in Syria that we were able to contact, heads of fighting groups, most of them also agree on the principle of the ceasefire,'' he said.

?If this humble initiative succeeds, we hope that we can build on it in order to discuss a longer and more effective cease-fire and this has to be part of a comprehensive political process,'' Brahimi said.

The Associated Press and Reuters contributed to this report.

Halloween Costumes Are Your Only-Prime-Shipping-Can-Save-You-Now Deal of the Day

I just got invited to a Halloween party this weekend. That's great; it means I have friends! But I don't have a costume. This happens every year—I toss around great conceptual costume ideas, but then October 24th rolls around, a week before Halloween, and I've got nothing. Some of you are in the same situation. Sure, if you've got two iPads you've got a great creepy costume, but most people in this spot usually settle for a half-assed reappropration of street clothes, or they run to a big-box store and pay full price for a outfit they only wear once. PSY-ops? Navy robot goes 'Gangnam Style'

5 hrs.

A humanoid robot that may someday evolve into a fearless firefighter aboard U.S. Navy warships has become infected with the "Gangnam Style" dancing virus.

Luckily, the CHARLI-2 robot does not have a real computer virus. But its human overseers at the Robotics & Mechanisms Laboratory at Virginia Tech decided to make the robot bop along to the viral South Korean pop song by artist PSY ? even sneaking in the infectious song's signature horse-riding and lasso-waving moves during the new YouTube video (see below).

Dancing robots almost seem a dime a dozen these days, so CHARLI-2's display of dancing prowess doesn't represent anything special as far as robotic capabilities ? it manages the arm movements rather more successfully than the leg moves. The robot has done much more in its day job as a humanoid research platform capable of walking and playing soccer.

Still, the robot's dancing has gone viral on its own with more than 252,000 views since being posted on Oct. 19. YouTube reactions predictably range from "Arnold Schwarzenegger will do this dance in Terminator 5" to an all-caps exclamation of "SKYNET IS ONLINE!"

In any case, the Virginia Tech robot's record certainly impressed the U.S. Navy ? the Navy envisions CHARLI-2 as a forerunner for creating a Shipboard Autonomous Firefighting Robot (SAFFiR) that could work with human sailors to battle fires aboard warships at sea.

SAFFIR would need to have the capability to handle fire hoses, throw fire extinguisher grenades, climb ladders and maintain its balance as it walks the decks and corridors of Navy ships.

Chronic constipation linked to increased risk of colorectal cancer

ScienceDaily (Oct. 22, 2012) ? Patients with chronic constipation may be at increased risk of developing colorectal cancer and benign neoplasms, according to study findings unveiled October 22 at the American College of Gastroenterology's (ACG) 77th Annual Scientific meeting in Las Vegas.

The study, "Risk of Developing Colorectal Cancer and Benign Neoplasm in Patients with Chronic Constipation," investigated the prevalence and incidence of colorectal cancer and benign neoplasms in 28,854 patients with chronic constipation (CC) and 86,562 controls without CC that were identified from a large retrospective U.S. claims database (January 1999-September 2011). Patients with at least two diagnoses of constipation were required to be 18 years or older and continuously enrolled in their health plan for at least one year following the study index date, which was the patient's first eligible diagnosis of constipation. Patients with diagnoses of irritable bowel syndrome or diarrhea were excluded.

Researchers found that:

? Both colorectal cancer (CRC) and benign neoplasms are more prevalent in chronic constipation patients compared to a control population free from chronic constipation.

? Among the patients that were not previously diagnosed with CRC or benign neoplasms prior to their index date, and after controlling for potential confounding factors including age, gender, family history of malignancies, and other non-gastrointestinal comorbidities, patients with CC were more at risk to develop CRC or benign neoplasms.

? The risk of developing CRC was 1.78 times higher for chronic constipation (CC) patients and the risk of developing benign neoplasms was 2.70 times higher. After adjusting for potential confounding factors, which are potentially also associated with the CC conditions, the incremental risk of developing CRC and benign neoplasms remained "consistently high."

"This study demonstrates an association, not causation, between chronic constipation and both colorectal cancer and benign neoplasms" said co-investigator Nicholas Talley, M.D., Ph.D., of the University of Newcastle. "The postulated causal link between constipation and increased colorectal cancer risk is that longer transit times increase the duration of contact between the colonic mucosa and concentrated carcinogens in the lumen, such as bile acids or other carcinogens."

"The association between constipation and colorectal cancer deserves further exploration to better understand possible causal elements," said Dr. Talley. "Moreover, a review of the existing literature suggests prospective cohort studies have not identified this association. Thus, the findings may reflect recall bias."

"In this study, patients with chronic constipation were found to be at increased risk of developing colorectal cancer and benign neoplasms, said Dr. Talley. "Although chronic constipation is considered a relatively benign disease, practitioners should be aware of this potential association to monitor and treat accordingly," said Dr. Talley. "We encourage anyone with questions related to their condition to talk to their health care professional so that the specific health needs of each patient can be balanced with the risks and benefits of medications."

He also noted that further research is warranted to evaluate whether patients who have their constipation well controlled are at lower risk of developing CRC and benign neoplasms. "Longitudinal prospective studies to understand the causal relationship between chronic constipation and CRC would advance our understanding of prevention and management of these disorders."

About Chronic Constipation

Constipation, one of the most common gastrointestinal complaints in the United States, occurs when the colon absorbs too much water or if the colon's muscle contractions are slow or sluggish, causing the stool to move through the colon too slowly. As a result, stools can become hard and dry. More than 4 million Americans have frequent constipation, accounting for 2.5 million physician visits a year, according to the National Digestive Diseases Information Clearinghouse (NDDIC).

Chronic constipation is a condition of infrequent bowel movements -- typically fewer than three bowel movements a week -- and difficult passage of stools which does not go away. In some cases, CC may be caused by an underlying medical condition.

About Colorectal Cancer

Colorectal cancer is the third most commonly diagnosed cancer and the second leading cause of cancer death in both men and women in the US, according to the American Cancer Society. It is estimated that there will be 143,460 new cases diagnosed in the United States in 2012 and 51,690 deaths due to this disease. The American College of Gastroenterology's screening guidelines recommend colonoscopy as a "preferred" colorectal cancer prevention strategy beginning at age 50 (age 45 for African Americans.)

Japan: Joining the Nuclear Weapons Club? It Could. ? The Naval Diplomat

Conventional wisdom holds that Japan is what nonproliferation specialists call a ?threshold? nuclear weapon state ? a country that could stage a nuclear breakout virtually overnight should its electorate and leadership resolve to do so. Estimates commonly bandied about run from six months to a year. Toshi Yoshihara and I take aim at such assumptions in Strategy in the Second Nuclear Age. Japanese bombmakers might manage a crude device within that timeframe, but that?s a far cry from a weapon ready for battlefield use.

RALEIGH, N.C. ? A rethink of four-winged dinosaurs suggests that the much-debated hind wings stayed tucked under the body until deployed in the air for tight turns to dodge branches or chase prey.

Just what a dinosaur did with well-developed feathers on all four of its limbs has been a puzzle since the 2003 unveiling of roughly 130-million-year-old Microraptor gui fossils from northeastern China. The first reconstruction showed the small dinosaur gliding in the air with all four limbs extended outward. A later proposal lowered the hind-limb feathers for a Wright-Brothers biplane of wings. Both arrangements have drawn criticism.

In a simpler solution, the dinosaur could have kept its hind limbs under its body much of the time until needed for banking in a turn, Justin Hall of the University of Southern California said on October 20 at the annual meeting of the Society of Vertebrate Paleontology. Extending a feathery right leg a bit while veering left, or vice versa, could easily have shrunk the turning the radius by a notable amount depending on the leg angle, he and his colleagues calculated.

That boost for agility makes more sense aerodynamically than keeping both Microraptor hind limbs extended, Hall said. The probable shape of the hind legs? feather array wouldn?t have generated much lift, so the extra surface would have been worse than useless for straight-ahead moves. ?For every surface, you pay a little drag tax,? said coauthor Michael Habib, also at USC.

In contrast, deft maneuvering would have helped the forest-dwelling M. gui cope with complex obstacles. Also, Habib said, the four-winged dinosaur still had the basic body shape of its terrestrial lineage, and feathered legs and a large tail fan could have helped compensate when in the air.

M. gui may be the best known of four-winged dinosaurs, but paleontologists have since found several more. The researchers? method of calculating an agility boost should work for all four-winged species, said coauthor Luis Chiappe of the Natural History Museum of Los Angeles County. And, Habib said, agility should matter regardless of whether a four-winged dinosaur could power along in sustained flight or just glide.

Powered flight and gliding downward have developed in quite different evolutionary branches, said Kevin Padian of the University of California, Berkeley. Maneuverability is certainly important to both, but he does not see gliding as an evolutionary baby step on a path toward powered flight.

Recon Instruments offers Flight HUD goggles for wingsuit pilots and skydivers

Recon Instruments offers Flight HUD goggles for wingsuit pilots and skydivers

Recon Instruments has decided to take its wares off the slopes and into the air, provided enough people bite. The Flight HUD is built around the same core as its ski goggles, but has been tweaked to offer information more relevant to skydivers, base jumpers and wingsuit pilots. The tiny LCD just below the field of vision displays speed, altitude and glide ratio in real time. Rather than simply guess how fast they're going, adrenaline junkies will be able to see accurate data in the moment and make the appropriate adjustments. Obviously, this is a rather niche market, so Recon Instruments has set a goal: 250 pre-orders to trigger a production run. The early birds can pick up a Flight HUD for $299, while every order placed after the initial 250 will cost $349. To get a run down of the proposed product from renowned aerial daredevil Jeb Corliss check out he video after the break.

Royal Society Runs Science Women Wiki Marathon

60-Second Science

The Royal Society is looking for volunteers create or enhance entries on female scientists, mathematicians and engineers. Karen Hopkin reports

More 60-Second Science

Quick: name a famous female scientist. If you said "Marie Curie," you?re not alone. In fact, a lot of people can?t think of a single other example. Well, England's Royal Society is fixin? to rectify that. On Friday, October 19th, it?s sponsoring a Wiki-editing marathon for articles about women in science.

Wikipedia is the go-to source for information on pretty much everything. But its coverage is a little light when it comes to the achievements of women in science, technology, engineering and math. So the Royal Society is looking for volunteers with wi-fi and a bit of Wiki knowhow to create or enhance entries on female scientists.

Suggestions include Lilian Bland, the first woman to build and fly her own aircraft; Martha Ludwig, who helped solve the first protein crystal structure done in the US; and Barbara Crawford Johnson, the only woman to serve on the NASA team that engineered the moon landing.

You can take part in the effort using Twitter. The hashtag is #WomenSciWP. That?s women-S-C-I-W-P. So give Marie Curie a well-earned rest and help other women in science get the wiki-recognition they deserve.

U.S. sees "open channel" with Myanmar on human rights

WASHINGTON (Reuters) - The United States has concluded its first set of human rights talks with Myanmar and is confident it now has an "open channel" to discuss political prisoners and other sensitive subjects as ties improve, the State Department said on Wednesday.

Michael Posner, the State Department's top human rights official, led the U.S. team at the talks in Naypyitaw, the capital of Myanmar, which is also known as Burma.

The talks come as the Obama administration dismantles longstanding sanctions to reward Myanmar's leaders for political and economic reforms.

"The results of the dialogue were assessed to be very positive and we look forward to continuing these discussions with Burmese authorities," State Department spokeswoman Victoria Nuland told a news briefing.

"We weren't sure whether the Burmese would be open to addressing all of those issues, and they were," Nuland said.

"We are confident that we have now an open channel with the government of Burma to discuss human rights and to continue to work on bringing them where they want to be in terms of human rights standards for their government."

The U.S. delegation also included Deputy Assistant Secretary of Defense Vikram Singh and other U.S. military officials, a signal that the Pentagon also is watching closely as Myanmar begins moving out of the shadow of China, long its chief regional ally.

RAPID CHANGES

The United States has seen ties warm rapidly with Myanmar since a quasi-civilian government took office there in March 2011, ending five decades of military rule.

The new government has launched rapid reforms, including an overhaul of the economy, an easing of censorship, the legalization of trade unions and protests, and the freeing of political prisoners.

The United States has responded with diplomatic and economic gestures, sending Secretary of State Hillary Clinton to Myanmar last year and easing sanctions.

Myanmar released its latest group of political prisoners last month, just before Myanmar President Thein Sein and veteran pro-democracy leader Aung San Suu Kyi visited the United States on separate trips.

"We have all spoken out about the need to get to zero in terms of political prisoners and we're continuing to work with the government of Burma on that," Nuland said.

The United States has also expressed concern over ongoing fighting with ethnic minority groups and violence against ethnic Rohingya Muslims in Myanmar's western Rakhine state, as well as the government's continued military ties with North Korea.

Activists say the United States has pressed Myanmar consistently on human rights but warn that a surge in economic and other ties could may push the issue down the priority list.

"The simple fact is that U.S. policy toward Burma is no longer just about human rights," said John Sifton, Asia advocacy director at Human Rights Watch.

"Now human rights is just another sector that is part of the dialogue and there are other folks at the table, from the military to the business community, who have their own wish lists. As a result it is that much harder to focus the pressure."

Regulators send banks mixed messages on capital

LONDON (Reuters) - Britain's financial regulators sent banks mixed messages on Wednesday, saying they should trim surplus reserves to help the struggling economy although they need more capital as the worst may yet be to come.

British banks have been forced to build up large capital defences since the 2007-09 financial crisis, when some like Royal Bank of Scotland and Lloyds had to be rescued by taxpayers - something the public does not want repeated.

Banks now hold greater reserves than the minimum international standards known as Basel III being phased in from January.

The Bank of England's Financial Policy Committee, which monitors risks in the financial system, said in September that banks could trim reserves if they lent the freed-up money to businesses but that banks should also build up core defences, by cutting bonuses if need be.

Two FPC members speaking at the British Bankers' Association's annual conference in London repeated this apparently conflicting guidance on Wednesday.

"We are in very difficult circumstances at the moment in the sense that huge risks are behind us. There is still a tangible probability - not a high probability - that the worst may still be ahead," Bank of England Deputy Governor Paul Tucker said.

Even the new Basel rules designed after the financial crisis were not enough to ensure banks had adequate defences, he said.

"Basel I, II, III, IV and V are not calibrated for the kind of end of the world risks that lie within the realms of the possible at the moment," he said.

"If we get a tidal wave, we may all be grateful that there are a few billion more in capital here and there in the banking industry, keeping banks in the private sector rather than the dead hand of state ownership," he continued.

But Andrew Bailey, head of banking supervision at the Financial Services Authority said the FPC was grappling with trying to get a clear message to banks on how big their capital defences should be to remain resilient.

Bailey said there was a need to fill in "what for me is the big gap at present, namely how we explain and calibrate the resilience objective in terms of capital".

The FPC will focus on this at its next meeting and monitor how any trimming of capital defences has worked.

"We will be prepared to amend our judgements in the light of experience," Bailey said.

MIXED MESSAGE

Bankers said privately that the mixed "good cop, bad cop" message from regulators was partly due to the FPC's added remit of helping economic growth as well as maintaining financial stability, two objectives that can contradict each other.

The FPC is one of a new breed of watchdog practising that seeks to cool asset bubbles before they destabilise the economy or cut some slack for banks in tough economic conditions.

"It shows that supervision is an art and not a science," said Paul Chisnall, executive director of the BBA.

"The process of supervision is evolving. There is a new dynamic between the overall level of capital in the financial system and the ability to adapt this to give some assistance to help the economy," Chisnall said.

Bailey conceded that FPC members were trying to flesh out a clearer line on capital and what type was needed.

"This danger of creating uncertainty exists because we are finding our way in a new and difficult area of policy," Bailey said.

Rolls Royce Finance Director Mark Morris also urged regulators to find the right trade off between regulation and financial stability.

"The balance between stability and growth is a fine judgement, which we feel ? is being overlooked more in favour of regulation rather than growth. If the patient is on the operating table, our view is, don't kill him, resuscitate him and try and keep him alive," Morris told the BBA conference.

Bailey said the FSA is still requiring banks to build up their core Tier 1 ratios - a benchmark of a bank's health - in line with new global Basel III minimum capital requirements from January.

Where banks are being given latitude is in scaling back on capital they hold above the regulatory minimum, know as Pillar 2, and set at the discretion of supervisors, Bailey said.

Since 2008, this type of capital that sits on top of the regulatory minimum has risen from just under 20 billion pounds to 150 billion pounds.

WWYD- Husbands craptastic 401k plan

My husband works for a firm that is based in another state. He's the only employee in this state.
They offer a 401k to employees who have been there a year.
They offer a match of $1 for every $1 up to $1000/year.
That all sounds good.

Up till now, since he's worked for small firms, he's just been doing IRAs w/catchup... And I've born the brunt of the tax advantaged savings by maxing my 401k and catchup.

The problem with the 401k he's being offered - it's 100% full of load funds.
The loads vary from 5.75% (stock funds) to 3.75% (bond and/or money market funds.)

I think the $1k/year match is still worth it... And if he participates in the 401k, he can't do the IRA. So I told him to do $6k /year into the 401k, and any money left over can go into taxable savings (same as before.)

I suggested he put it in the bond fund - and I'll adjust my asset allocation to account for this 100% bond allocation on his side. I just can't see giving up 5.75 cents for every dollar to loads. It's bad enough giving up almost 3.75 cents/dollar.

Should we have just stayed with IRA?

FWIW - he's retiring in Jan 2014... so we only have to deal with this craptastic plan for 1 year.

Crapastic! What a great word. Very descriptive.

Even though you are paying excessive fees, for the $1000 you put in you get an immediate additional $885 - the employer match minus all the fees. Grit your teeth and do it. When he leaves, roll it over into an IRA.

Actually our plan is to have him put $6000 in. That's what would go into an IRA. He isn't allowed to do both a traditional IRA and a 401k.

His employer is relatively small - around 50 people. But they're all highly educated... you'd think they'd want to avoid the fees. Not sure if it's possible to get a no-load 401k plan set up for 50 employees or less.

If your husband is 59 1/2 of age, can't he transfer his money out to an IRA ?

I would leave a small amount and capture the company's match of $ 1K. I know this is an early retirement forum, so you and he maybe alot younger than the 59.5....

You may not be able to deduct it, but as I understand it, you can still contribute, and the earnings from that point on are still tax-deferred.

I've always wondered about this myself, since we both contribute the max to our 401(k)s and our household income exceeds the amount that would allow us to contribute to individual retirement accounts outside of those company 401(k)s.

But if that limitation is only for "tax deductable" contributions and still allows after-tax dollars to be contributed, is there a maximum of after-tax dollars that can be contributed each year and does it make financial sense to do that instead of putting the money into regular after-tax investment accounts?
